🚀US Copyright Office Says 'No Way, AI': Midjourney Images Not Eligible for Copyright

Attention, all artists and AI enthusiasts! The US Copyright Office has reconsidered its previous decision to grant copyright protection to Kristina Kashtanova's comic book, Zarya of the Dawn, which was created using an AI image generator called Midjourney. While Kashtanova is recognized as the author of the book's text and the arrangement of its written and visual elements, the registration for the images has been cancelled as they were not created by a human.

But don't despair, AI art lovers! Kashtanova sees this as a victory for artists using Midjourney and similar tools, as the arrangement of images in a book is still copyrightable. Plus, her lawyers are looking at ways to prove that individual images produced by Midjourney are a direct expression of her creativity and therefore copyrightable.

However, the Copyright Office has dismissed the claim that Kashtanova's edits to the images make them eligible for copyright, arguing that the changes were either too minor or that they couldn't determine her contributions. Kashtanova's lawyer, Lindberg, disagrees and says that the errors stem from a core misunderstanding of how randomness plays a role in Midjourney's image generation.

In the end, Lindberg argues that AI-assisted art should be treated like photography, as it's just a matter of time before it's accepted as a legitimate form of artistic expression. So, keep on creating, AI artists, and don't let the haters bring you down!
